Prosecutor General's (PG) office has forwarded the case of the unconstitutional arrest and subsequent detention of Chief Criminal Judge Abdulla Mohamed against former President Mohamed Nasheed and former Defence Tholhath Ibrahim Kaleyfaanu for prosecution today.
In addition to Nasheed and Tholhath, former Chief of Defence Force Moosa Ali Jaleel, Brigadier General Ibrahim Mohamed Didi and Colonel Mohamed Ziyad is also being prosecuted according to PG’s office.
All five are being charged with the arrest and detention of a person not found guilty of a crime by a court of law.
PG’s office had forwarded the case to the Hulhumale Court. It is known that the case has not been forwarded to the Criminal Court as Judge Abdulla is the Chief Judge and hence would involve conflict of interest.
Despite pressures from both international and local parties, Judge Abdulla had been detained in a military training facility at Kaafu Atoll Girifushi for 22 days.
Police had tried to obtain a statement from Nasheed pertaining to the case for the investigation. But following his refusal police had gone ahead with the investigation without the statement.
Former Home Minister Hassan Afeef had revealed in his police statement that Maldives National Defence Force (MNDF) had been requested to take action against Judge Abdulla after he was deemed as a threat to national security.
